HC dismisses petition in recruitment case

A division bench of the MPHC comprising Chief Justice, S K Seth and Justice, Vijay Kumar Shukla has dismissed the petition filed by Raksha Nathawat and others against the High Court of Madhya Pradesh. Petitioners applied for direct recruitment on the post of Civil Judge, Class-II pursuant to the advertisement issued by the High Court. They qualified in the prelims, but their candidature was rejected by the High Court on the ground that both of them had not passed the LLB examination on or before January 20, 2019 (the cut-off date for the submission of the application).
 
Since the candidature of petitioners was rejected before the main examination, they have rushed to this court, seeking appropriate relief and directions. Advocate Vinay Kumar Tiwari Advocate along with Joginder Singh, Registrar (Exam) appearing for the High Court, on advance copy, submitted that, after the order impugned was passed, petitioners have supplied the details, which shows that they had passed the LLB examination prior to the cut-off date (January 20, 2019) and petitioners have supplied the corrected mark-sheet in the examination cell. Joginder Singh, Registrar (Exam) submitted that, the matter was placed before the committee and the committee prima facie found that petitioners had passed the LLB examination before the cutoff date (January 20, 2019) and therefore, they were eligible.
 
The committee is, therefore, allowing the petitioners to participate in the written examination scheduled on April 26, 2019 and April 27, 2019 subject to verification of documents. In view of this, Advocate K C Ghildiyal, counsel for the petitioners, submitted that nothing survives in the writ petition and therefore, he seeks permission to withdraw the writ petition. In view of the open court statement made by Advocate Ghildiyal, writ petition stands dismissed as withdrawn, the division bench said.
