Casual moderation leads to mess in RTMNU Law paper

Many senior Law teachers blamed the faculty of Humanities for using juniors for setting the question papers resulting in sufferings of brilliant students
 
 
How a casual approach can lead to messing up things is evident from the incident in which Rashtasant Tukadoji Maharaj Nagpur University (RTMNU) repeated two questions in the paper ‘Intellectual Property Law’ of LLB (three years) of Semester IV exam conducted on April 26. The question on Anton Pillar Order is being asked consecutively for the last six years. Repetition of questions may be very small issue but the kind of treatment being meted out to the intelligent students by University shows its brazenness.
 
According to some senior teachers the mess in the paper might have taken place because the paper was set either by very junior teacher of Law or some senior students or teacher of some other subjects considering the vastness of Humanities, the faculty under which subject of Law comes. Two questions of five marks each are given in Section B. They include -- Explain the conditions of patentability (Question 2 C) and Short notes: Function of Trademark
 
(Q 3) have been repeated in the same paper in Section C of eight and four marks, respectively -- Define patent (Question 9) and What are the essential requirement of valid patent (Question 11 (i)) and Functions of Trademark (Question 11 (ii). ‘The Hitavada’ spoke to senior teachers of law. They explained the situation on condition of anonymity. They made it clear that they did not have animosity with anyone but they wanted the system to be streamlined as it was hampering the prospects of intelligent students. The casually set question paper is no less than a cruel joke for the students who are studying law with serious approach.
 
One teacher pointed out, “Humanities is like an ocean. Anybody can come and set the paper is a fact. It should be moderated by experienced teachers, instead it is being done by juniors. There should be some status. There is no check on the system. In some cases even the students are being asked to moderate, do the valuation. Whither University is going is a million dollar question. The possibility of teacher of History moderating the paper can not be ruled out. Because whosoever the in-charge, he or she wants to get work done. Somebody should question the internal things.”
 
Another teacher said with a regret that junior most is being given the headship of Post Graduate courses. “Most of the junior teachers carry notes with them while teaching law. They even don’t read CrPC, what is the Constitution, they are not aware of definition of IPR. How could they teach Law in a proper way and what knowledge they would impart to the students whose parents have handed over their wards to the institution,” questioned the teacher. Unfortunately the handful of seniors and good teachers don’t work, the fact which can not be ignored, added this teacher. Some teachers alleged, “They have set of examiners and only those keep coming for the work of moderation or valuation. Obviously questions are to be duplicated. Even while evaluating the answers nobody takes pain to read it. I suggest that questions should be of objective type.
 
At least right answer will get right marks with sheet of answers to be with the valuers.” Dr Yeole assures measures on Law paper fiasco When contacted Dr Pramod Yeole, Pro-Vice Chancellor of RTMNU, he said, “We did not receive any complaint, as it must have benefited them. Only genuine students might have faced the problem. But, on the basis of whatever you brought to my notice, I shall convene a meeting to discuss the issue.
 
It is very serious and needs to be dealt with proper approach. We will send the matter to Disciplinary Action committee to find out the culprit.” BBA issue resolved Students who attempted the question number 2 of BBA VI semester of Fundamentals of Business Finance heaved a sigh of relief as University has not only admitted the mistake but also decided to allot the marks. The question was ‘A company is planning to acquire a machine costing Rs 1,40,000 and having economic life of 6 years and salvage of Rs 20,000 after full usage of economic life. The company is estimating following profits before depreciation and taxes for next 6 years. Assuming the discounting rate of 10% and tax rate is to be assumed at 50%; determine the (I) Pay Back Period and (ii) Net Present Value’. In this question the profits values are not given due to which students could not write the answer.
