Gangster Tapan Sarkar’s aide denied anticipatory bail

A Sessions Court here in Durg has denied anticipatory bail to extortion accused Tamradhwaj Yadav, aide of dreaded goon Tapan Sarkar. The accused had pleaded that the Chhaoni Police had falsely implicated him in the case. Anticipating his arrest, the accused had filed the anticipatory bail plea in the court of First Additional Sessions Judge, Ajit Kumar Rajbhanu, who denied bail to him and rejected his plea.
 
 
The applicant/accused has been identified as Tamradhwaj Yadav alias Monu (36), son of Premlal, a resident of Subhash Nagar, Kasarideeh, Durg. The victim Niyaz Siddiqui, in his complaint lodged with the Chhaoni Police, had stated that Tapan and his aides including the applicant Tamradhwaj besides others extorted money from him and forced him to operate an IPL betting racket. Based on the complaint, the Chhaoni Police had registered an offence against the accused under sections 384, 386 and 506-34 of IPC.
 
 
The applicant in his bail plea stated that he has not past crime records and the Chhaoni Police had falsely implicated him in the case. Seeking relief from arrest on health grounds of his wife, he also pleaded that his first child was a premature baby and presently his wife is pregnant for the second time while the doctors had confirmed that owing to medical complications, this time too she had to go for a premature delivery. He said that he needs to be with her for support. The applicant had further argued that the other accused connected with the case are either given anticipatory or regular bails by the courts and hence he should also be given its benefit. Meanwhile, the Additional Public Prosecutor, Fariha Amin had objected bail to the accused.
 
 
After the submissions, the Additional Sessions Judge Ajit Kumar Rajbhanu concluded that the victim in his statements given under section 164 of the CrPC has made statement against the applicant while another accused Gopal Takla has also taken his name in the memorandum statement. Observing that the nature of complaint against Tamradhwaj is different from those who have managed to secure bail, the Sessions Court denied bail to him.
