AG’s removal irks Singh, Jogi; say State under constitutional crisis

By issuing a midnight order the State Government appointed Advocate Satish Chandra Verma as the new Advocate General of Chhattisgarh by replacing the incumbent Advocate General Kanak Tiwari 
 
Bharatiya Janata Party National (BJP) Vice-President Dr Raman Singh and Janta Congress Chhattisgarh (Jogi) Founder President Ajit Jogi has termed that Chhattisgarh is presently going through a phase of constitutional crisis. The BJP National Vice-President, in his tweet which he made on Saturday morning, stated that the incumbent INC Chhattisgarh Government has created a situation of constitutional crisis in State. Commenting on the unceremonious exit of Advocate General Kanak Tiwari, Dr Singh said Advocate Kanak Tiwari has stated that he’s not tendered any resignation and even the Raj Bhawan maintaining that it didn’t receive resignation letter from Advocate General Kanak Tiwari. Singh added that Chief Minister Bhupesh Baghel should clarify as to how he had accepted the resignation of AG Kanak Tiwari. By issuing a midnight order the State Government appointed Advocate Satish Chandra Verma as the new Advocate General of Chhattisgarh by replacing the incumbent Advocate General Kanak Tiwari. The order stated that in exercise of the powers conferred by Clause (1) of Article 165 of the Constitution of India, the Governor of Chhattisgarh is pleased to appoint Additional Advocate General Satish Chandra Verma as Advocate General Chhattisgarh, in place of Kanak Tiwari, Advocate General, with immediate affect. Quoting Article 165 of Constitution of India, the BJP raised question that the Advocate General for the State can be appointed by the Governor and a resignation tendered by a Advocate General (AG) can be accepted by Governor and only Governor can remove an AG. As per Article 165 of Indian Constitution, the Governor of each State shall appoint a person who is qualified to be appointed as a Judge of a High Court to be Advocate General for the State and the Advocate General shall hold office till the pleasure of the Governor, and shall receive such remuneration as the Governor may determine. Accordingly, the BJP maintained that since the Raj Bhawan didn’t receive any resignation from AG Kanak Tiwari, it is unconstitutional to appoint a new AG. Meanwhile, through a communiqué issued the JCC (J) Founder President Ajit Jogi has stated that since last five months anarchy is prevailing in the State. Due to a situation of constitutional and administrative crisis, all development works in State have come to a halt. Jogi said posts are under tyrannical influence of State Government and unceremonious removal of Advocate General is one such blatant example. He said administrative officers are being targeted by opening enquiry against them. Since State Government is functioning on a policy of vendetta, schemes of state interest are severely affected. It is high time that an effective check should be put on such activities or else very soon the state would move to a tyrannical rule due to prevailing administrative anarchy.
