   Date :13-Jul-2019

As no one turned up on behalf of Rashtrasant Tukadoji Maharaj Nagpur University (RTMNU) in response to the High Court’s notice for final disposal of the writ petition filed by Samarth Mahavidyalaya, Lakhani (Bhandara district) on June 27, 2019, after adjourning the motion-hearing of the case twice earlier, Justice R K Deshpande and Justice Vinay Joshi have admitted the petition for early final hearing.

The petition is directed against the University’s decision to freeze the admission to the First Year course in the petitioner college for the year 2019-20, through its impugned communication of May 15, 2019. The court’s attention was invited to the norms for the purpose of eligibility. The petitioner has acquired 149 marks and the recommendation is that for two years the affiliation should be granted. Though the petitioner has satisfied the norms, the order of freezing the admissions has been passed. The court has granted interim relief by way of staying the operation of the impugned communication to the extent it operates to the prejudice of the petitioner-college. Adv Dr Renuka S Sirpurkar appeared for the petitioner.
