Show cause notice to poll officer in matter challenging Khargapur MLA’s election

In the matter related to challenging the election of Member of Legislative Assembly of Khargapur, Tikamgarh district, the single bench of the Madhya Pradesh High Court comprising of Justice Nandita Dubey has issued show cause notice to the District Election Officer, Tikamgarh, as to why the order dated on August 21, 2019 has not been complied with. The single bench has heard the election petition filed by Chanda Singh Gour against the Rahul Singh Lodhi, MLA, Khargapur and nephew of Uma Bharti, ex-Chief Minister of Madhya Pradesh.
 
During the hearing, In compliance of order dated on august 21, 2019, Anil Kumar Pandit, Assistant Registrar, Firm and Society, Sagar, has produced the record before the court in the sealed cover. However, as directed earlier the District Election Officer has not produced the record. Let show cause notice be issued to the District Election Officer, Tikamgarh, as to why the order dated on August 21, 2019 has not been complied with. Let a copy of this order be supplied to the counsel for the State for information and necessary compliance.
 
The single bench has listed this matter on September 25, 2019. In the previous hearing of the case, the single bench of the MPHC had issued summons to the District Election Officer, Tikamgarh, to produce the original nomination papers i.e. Form No.5/LA-47/2018 and Form No.20/LA-47/2018 and also to the Assistant Registrar Firm and Society, Gopalganj, Sagar to produce the documents in respect of withdrawing from the partnership of RS Construction Company. The District Election Officer as well as Assistant Registrar Firm and Society, Sagar also had directed to produce the record as above stated on September 11, 2019. But the district election officer Tikamgarh did not produce the record.
