THE Tihar Jail authorities here on Wednesday told the Delhi High Court that “hanging of the four convicts in the Nirbhaya rape and murder case can’t take place on January 22.” “Execution of convicts will surely not take place on January 22. The fate of a death-row convict comes to a finality only after his mercy plea is rejected by the President. “Also, it can only take place 14 days after the mercy plea’s rejection. The prison rules say a 14-day notice must be provided to the convicts after rejection of the mercy plea,” said Delhi’s standing counsel Rahul Mehra.
 
The arguments were presented before a Division Bench, comprising Justice Manmohan and Justice Sangita Dhingra Saihgal, which was hearing a plea filed by Mukesh challenging the death warrant issued against him. Mehra also opposed the petition terming it premature as the mercy plea was with the Home Ministry of the Delhi Government and would be moved to the Lieutenant Governor later in the day. After hearing the arguments, the Bench refused to set aside the death warrant issued against the petitioner .
 
System suffers from cancer, capable of being exploited by convicts, observes HC: THE Delhi High Court on Tuesday pulled up the AAP Government and the prison authorities for creating a system which was “suffering from cancer” and “capable of being exploited” by death row convicts who wanted to “strategically” delay their execution. The strong remarks by a bench of Justices Manmohan and Sangita Dhingra Sehgal came after the Delhi Government and prison authorities told the court that none of the four convicts in the Nirbhaya gang rape and murder case could be hanged on the scheduled date of January 22 as one of them has moved a mercy plea. The High Court also pulled up the Delhi Government and prison authorities for the delay on their part in issuing a notice to the convicts informing them they can move mercy pleas before the President. 
 
Delhi Govt for rejecting mercy plea

THE Delhi Government on Wednesday recommended rejecting the mercy plea filed by Mukesh Singh, one of the four death row convicts in the 2012 Nirbhaya gangrape and murder case, and forwarded it to the LG at “lightning speed”, Deputy Chief Minister Manish Sisodia said. He said that the recommendation on the mercy petition of 32-year-old Singh will now be sent to the Union Home Ministry. The decision comes a day after Singh filed the plea. “We learnt that a petition has been filed and we have recommended its rejection and sent it at lighting speed to the LG. There will be no delay from our side, we can assure you that,” he said in response to a question.
