TBZ Director booked in fresh offence of forgery

AS per the orders of Nagpur bench of the Bombay High Court, Sadar Police on Tuesday registered a fresh offence of forgery against Hemant Brijlal Zaveri, one of the directors of Tribhovandas Bhimji Zaveri & Sons Pvt Ltd (TBZ), in connection with the alleged gold fraud involving Rs 38.85 lakh. Director of well-known jewellery chain TBZ Hemant Zaveri (60), a resident of Worli, Mumbai, and other director(s) of the company had floated gold deposit scheme.
 
As the scheme appeared quite lucrative, Manish Kiran Deshraj (50), a resident of Flat No 3/2, Vali Apartment, opposite Durga Mandir, Katol Road, had deposited 1450 gram gold valued at Rs 38.85 lakh with TBZ’s Branch at Poonam Chambers, Chhaoni, in 2015 following an assurance by company directors of getting two per cent returns.
 
After some days, the TBZ branch stopped sharing the profit with Deshraj. When Deshraj sought returns on his investment, the officials at TBZ’s Chhaoni Branch kept dilly-dallying over payment. Subsequently, Deshraj lodged a complaint with Sadar Police who later registered an offence under sections 406 (Criminal breach of trust) and 420 (Cheating) of the Indian Penal Code (IPC) in 2018 against Hemant Zaveri. Similarly, the company allegedly cheated other investors. Following the complaints lodged by the victims, an offence under Sections 406, 420, 409 of the IPC, read with Section 3 of Maharashtra Protection of Interest of Depositors Act (MPIDA), was registered against Hemant Zaveri at Sadar Police Station.
 
Accused Hemant Zaveri then filed a bail application before the Nagpur bench of Bombay High Court. During the hearing, the counsel of accused Hemant Zaveri submitted 10 cheques in favour of Deshraj and six receipts. During verification, it was found that the cheques were forged and the gold deposited by Deshraj was never returned to him. After conducting an inquiry into the matter, the High Court ordered action against accused Hemant Zaveri. As per the statement of Deshraj and orders of the High Court, police registered an offence under Sections 465 (Punishment for forgery), 467 (Forgery of valuable security, will, etc), 468 (Forgery for purpose of cheating) and 471 (Using as genuine a forged document or an electronic record) of the IPC against Hemant Zaveri.
