Medha Patkar’s plea seeking quashing of old FIR dismissed

Justice S K Awasthi has dismissed the application filed by social worker, Medha Patkar seeking quashing of FIR registered for offence connected to a 19 year old case. Medha Patkar, along with other accused persons had entered the NVDA office at Barwani, broke the furniture, threatened the officials and prevented them from performing their duties. Justice S K Awasthi said in the order that the court was of the view that it was not a fit case to invoke the power to quash the FIR as well as proceedings as against the applicant who was absconding accused in the above case and the applicant was not entitled to get relief and petition was dismissed.
 
Applicant filed the petition for quashing of FIR registered at police station Kotwali, Barwani in Barwani district for offence punishable under Section 147, 148, 294, 353, 332, 506, 448, 426 of IPC, 1860 and Section 3 of Prevention of Damage to Public Property Act and the order dated passed by Chief Judicial Magistrate, Barwani in criminal case, whereby the applicant was declared as absconding and a perpetual warrant of arrest has been issued against her.
 
In brief, on March 3, 2001 at 11.15 am, the applicant and other accused persons entered the NVDA Office at Barwani and vandalised the office, threatened officials and prevented them from performing their duties. Executive Engineer Hemraj Rathore reported the matter to Barwani Police Station on the basis of which FIR was registered.
