Haldiram’s lookalike website names: HC asks domain registrars to file reply

Haldiram’s Foods International Pvt Ltd, a well-known name in food industry, has approached Senior Division Civil Court, Nagpur, raising concerns over lookalike domain names and requesting directions to the domain name registrars to take down such websites. On Wednesday, representatives of domain name registrars appeared before the court and sought more time to file reply. Accordingly, the court granted time to them and slated the next hearing on March 17. Haldiram’s operate their website in name and style as www.haldirams.com.
 
Many lookalike websites etc are created by fraudsters and on pretext of awarding dealership/distributorship of the Haldiram’s, lakhs of rupees were advanced by many people across India in the bank account of fraudsters, stated Adv Mahendra Limaye, Cyber Legal Consultant of Haldiram’s Foods International Pvt Ltd. According to him, the company started receiving many such complaints from the victims as well as from police authorities across India. The company issued public notice and also filed police complaint as a part of due diligence.
 
Adv Limaye stated that he sent a legal communication on behalf of the company to domain name registrars like Godaddy/Network Solutions and NIXI. However, he alleged, these domain registrars refused to take down the websites. Hence, he added, the company approached Senior Division Civil Court, Nagpur requesting for stopping such websites by directions to the domain registrars. After hearing the arguments in detail on February 3, Civil Judge Senior Division, Nagpur issued notices to respondents Godaddy.com, Network Solutions and NIXI as to why temporary injunction should not be granted against them. On Wednesday, Adv Limaye stated in a press release, representatives of GoDaddy and NIXI appeared before the court and prayed for some more time to file reply. The court granted them time to file reply and slated the next hearing on March 17.
