Kimsi acquitted; husband, uncle get lifer

Delivering the judgment in the murder case of Abhishek Mishra, a Sessions Court in Durg on Monday acquitted accused Kimsi Jain (Kamboj), while giving her ‘benefit of doubt’ and awarded life imprisonment to her husband Vikas Jain and uncle Ajeet Singh. Sessions Judge Rajesh Shrivatsava made it clear that both of them will have to stay in jail till their last breath. Sessions Judge also stated that the case cannot be categorised as rarest of the rare one. The judgment in the high profile case was delivered by the Sessions Judge Rajesh Shrivastava through video conferencing, which was attended by the accused and their lawyers, besides the Public Prosecutor Balmukund Chandrakar. It is worth mentioning that Abhishek Mishra, son of IP Mishra, chairman of Shankaracharya Engineering College was missing since November 10, 2015. The missing had created a sensation in twin cities and after 45 days, Police had recovered the body of Abhishek buried in the garden of a house at Smriti Nagar.
 
DNA testing was also done and the fact later came to fore that former employee of Shankaracharya College, Kimsi Kamboj, her husband Vikas and uncle Ajeet had hatched a conspiracy to kill Abhishek. After verifying call details of around thousands of numbers, the police had zeroed in on Vikas and Kimsi’s number and arrested the trio. The trial in the case began in 2016 and four District and Sessions Judges including Neelam Chand Sankhla, R K Agrawal, GK Mishra and Rajesh Shrivastava listened to the case. Meanwhile Kimsi was given benefit of doubt and acquitted while her husband and uncle were found guilty under sections 302 for murder, 120 (B) for criminal conspiracy and 201 for causing disappearance of the evidence.
 
They were awarded life imprisonment till their last breath under section 302 of the Indian Penal Code (IPC). Similarly, they were sentenced to 7 years imprisonment under section 201 and five year imprisonment under 120-B of the IPC. Sessions Judge also imposed a penalty of Rs 15,000 on each of the accused. Meanwhile, the counsel of the accused Advocate B P Singh has stated that they will appeal against the judgment in the High Court. On the other hand, lawyer for Kimsi, advocate Uma Bharti stated that she is satisfied with judgment and happy for Kimsi. She also said that efforts will be made for the release of the remaining two accused. Meanwhile, the brother-in-law of Abhishek Mishra, Nishant Tripathi and a complainant expressed disappointment. He specifically pointed that the lacuna in police investigations led to the acquittal of Kimsi. He has accused the police of not investigating the matter properly saying that the motive was missing from the entire case. He has also said that they will file an appeal in the High Court seeking justice.
