In the matter connected to ownership of some shops located in Andherdev, the main market of Jabalpur, 2 acres of commercial land in Bada Fuhara and about 100 acres of other agricultural land located in the district, the single bench of Justice Rajiv Kumar Dubey ordered Mohammad Asraf to file a reply with immediate explanation in the matter. The next hearing of the case will be on June 13.
On Monday, rather interesting turn of events took place at the Jabalpur High Court, during the hearing of a first civil appeal pending before it since the year 2006. A woman, Prabha Devi Mukherjee, a resident of Jabalpur, filed the first civil appeal in the year 2006 with regard to the ownership of some valuable shops located in Andherdev, the main market of Jabalpur, 2 acres of commercial land in Bada Fuhara and about 100 acres of other agricultural land located in district Jabalpur. During the pendency of the appeal, the appellant Prabha Devi died in the year 2015 while both his legal heirs sons, who were co-appellants in the said case, also passed away in the year 2012 itself. After the death of the last appellant Prabha Devi, a person named Mohammad Ashraf, a resident of Jabalpur, appeared before the court and filed an affidavit in the year 2016 to the effect that there is no legal heir to the family of the appellant Prabha Devi, hence his name in the case be joined as the appellant. When Anand Choudhary, the nephew of the departed Prabha Devi, who is a resident of village Rohana, and her legal heir hailing from district Hoshangabad, came to know about this fact, he immediately appeared before the High Court through advocate Dr. Rashmi Pathak for the long list of properties of his late aunt by Prabha Devi Mukherjee. Advocate Pathak mentioned that the fraud by Mohammad Ashraf for grabbing huge chunk of properties, was exposed and thus Anand Choudhary pleaded for his late real aunt Prabha Devi to be included as the appellant in place of Mohammad Ashraf. In view of the seriousness of the matter, the single bench of Justice Rajiv Kumar Dubey ordered Mohammad Asraf to file a reply with immediate explanation in the matter. The next hearing of the case will be on June 13.
