A division bench of High Court Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf dismissed the State Government’s appeal against retired employee. The case concerned recovery. Advocate Ashok Gupta argued on behalf of the respondent, Deepak Johri, a resident of Khandwa.

 

He argued that the respondent had retired from the post of dresser. A recovery of Rs 5,76,000 had been issued against him. The High Court termed the recovery as unfair and ordered the return of the amount along with interest. A contempt petition was filed when the amount was not returned.

 

Meanwhile, an appeal was filed by the state against the order of the single bench. According to the Supreme Court’s judgement, recovery from a retired employee is unfair. The High Court agreed with the argument and dismissed State’s appeal, upholding the earlier order of single bench.
