THE Jabalpur bench of the
Madhya Pradesh High Court
heard Giribala
Singh’s bail plea in
the Twisha
Sharma death
case on Thursday.
During the hearing, the CBI
clarified that the dowry death
charges have not been dropped
and the investigation into this
aspect is ongoing. The CBI
termed a portion of the amendment application filed by Giribala
Singh as factually incorrect. The
CBI stated that the charge of
abetment to suicide under
Section 108 of the Indian Penal
Code has been added to the
charge sheet, but the investigation into the dowry death aspect
is ongoing. Following this stance
by the CBI, the status of the dowry
death charge in the case remains
controversial.
WHAT THE HIGH
COURT SAID: A single bench of
Justice Ajay Kumar Nirankari
allowed Giribala Singh to
amend her bail application,
but limited it to the new charge
under Section 108 (BNS). The
Single bench has directed to
list the case on October 16 for
next hearing. The court clarified that the proposal to
remove the dowry death
charge through amendment is
not currently accepted. Earlier,
in the September 30 hearing,
the court had directed that the
bail application be amended
based on the changed sections.
Now, in the October 8 hearing,
the court has set a time limit
for amendments.
The court has not yet given
a final opinion on the merits
of bail in the case. The CBI is
investigating the case, and further bail hearings will be based
on the amended application
and the facts related to the
investigation.
