DCPs directed to take action against sellers violating noise rules

Firecrackers exceeding the 55-decibel noise limit are being sold openly in Nagpur despite restrictions. Even dangerous crackers such as ‘sutali bombs’ are available in shops. The Nagpur Bench of the Bombay High Court on Wednesday directed the concerned Deputy Commissioners of Police (DCPs) to take action against sellers violating the rules. During the hearing, Advocate Abdul Subhan, appointed as amicus curiae, informed the Bench of Justice Urmila Joshi-Phalke and Justice Raj Wakode that firecracker stalls had been set up next to each other without maintaining the mandatory three-metre distance. He also submitted photographs of the stalls to the court.

After hearing him, the court orally directed the DCP Zone III to take action against sellers offering firecrackers exceeding the 55-decibel limit. It also asked the DCP to personally look into noise pollution complaints from the Ambazari area and conduct an inquiry. The court orally remarked that the Commissioner of Police should personally look into the issue. It also observed that ensuring compliance with the Supreme Court’s guidelines was the sole responsibility and duty of the police.

A police team should be formed to monitor violations. The court also expressed concern over delays in acting on noise pollution complaints received through the designated portal. Technical reasons were being cited for the delay. On Tuesday, the court had orally questioned the police about the ban on sale and bursting of firecrackers exceeding 55 decibels. It had also sought details of action against sellers, wholesalers and individuals violating the rules. The Police Commissioner was directed to file an affidavit. The matter will be heard next on November 30.
