The complainant objected, stating that he did not intend to use the parking facility and only wished to drop off his mother and depart. However, the Mall management informed him that no free pick-up and drop facility was available at Ambuja Mall. Aggrieved by this, Advocate Shukla filed a complaint before the Commission seeking a declaration that the collection of parking charges by Ambuja Mall is illegal.
During the hearing, Advocate Shukla relied upon relevant judgments of the Gujarat High Court and various Consumer Disputes Redressal Commissions, and submitted that the parking fee collected by the Mall was unlawful. The complainant further sought compensation of Rs 50,000 for mental agony.
Taking cognizance of the submissions and legal precedents, the Commission held them to be legally sustainable and declared the collection of parking charges from vehicles by the Mall to be illegal. The Commission has accordingly directed the Mall to ensure provision of free parking.
This decision is being viewed as a significant judicial intervention towards providing relief to the general public.
