Justice Vishal Mishra has rejected 60 days temporary bail application filed by former RTO Constable Saurabh Sharma arrested for offences under Prevention of Money Laundering Act (PMLA), 2002. The applicant Saurabh Sharma has filed this application for grant of temporary bail for a period of 60 days relating to Crime dated December 21, 2024 registered at Police Station Directorate of Enforcement, Bhopal Zone, Bhopal (MP) for the offences under Sections 3 and 4 of the Prevention of Money Laundering Act (PMLA), 2002 on the ground of health condition of his wife.
In pursuance to the direction given by the court regarding health status report of applicant’s wife, the same has been placed on record by the respondent.
The temporary bail is pleaded on the ground that applicant’s wife namely Smt. Divya Tiwari is required to undergo sinus surgery.
As per the medical report, diagnosis of the wife is Chronic Rhinosinusitis (CRS), leftsided, with suspected migraine and the surgery (Septoplasty with Left Middle Meatal Antrostomy) has been advised.
It is submitted that there is no other responsible family member available to look after his wife. Under these circumstances, a temporary bail for a period of 60 days be granted to the applicant to enable him to take care of his wife. Counsel appearing for the respondent has pointed out that there is no emergency situation.
It is argued that earlier regular bail application of the applicant has been rejected on merits in detail vide order dated September 27, 2025 passed in MCrC No.
19270 of 2025, finding the involvement of the present applicant in the offence and the said order rejecting the application for regular bail was subjected to challenge before the
Supreme Court in Special Leave to Appeal (Crl.) No. 17044/2025 and vide order dated November 20, 2025, the special leave petition was dismissed as withdrawn. Counsel appearing for the respondent has drawn attention of this Court to the report given by the authority and has argued that as the health condition of applicant’s wife is not serious coupled with the fact that there are other family members available to take care of his wife, no case for grant of temporary bail is made out.
He has prayed for dismissal of the application. Justice Vishal Mishra has heard counsel for the parties and perused the record. The medical report suggests that there is no emergency condition coupled with the fact that during course of the arguments, it has been admitted that there are other family members available to take care of the wife including in-laws.
As the regular bail application of the applicant has already been rejected by this court by a detailed order dated September 27, 2025, finding involvement of the applicant in commission of the offence coupled with the fact that there is no serious emergency situation as pointed out in the report submitted by the medical expert, no case for grant of temporary bail is made out. Consequently, the application stands rejected, the single bench said in the order.
