UDD proposes no amenity space for developing land up to 5 acre

Objections, suggestions invited from all concerned for amendment to new Unified Development Control and Promotion Regulations
 
 
In 2018, the Urban Development Department (UDD), Government of Maharashtra published Development Control and Promotion Regulations (DCPR) for Nagpur Metropolitans Region. As per clause 24.4 of the DCR published on January 5, 2018, 10% amenity space was to be provided in any layout or sub division of plots or development proposal, having area more than 10,000 sq mtrs. (1 hectare or around 2.5 acre). In new Unified Development Control and Promotion Regulations (UDCPR) for Maharashtra State the same existing rule that says not to leave amenity space upto 4,000 sq.meter (1 acre) continued. But the Urban Development Department has submitted a proposal with an amendment, according to which the developer need not leave amenity space for the land admeasureing just less than 20,000 square metres or 5 acres.

This new rule is awaiting the approved yet but it is likely to get the green signal. The existing rule says no amenity space is needed for the land admeasuring upto 4,000 square meters. The developer has to leave the public utility space of 5% for the land of volume more than 4,000 square metres and upto 10,000 square metres. If the land is more than 10,000 square metres then developer is supposed to leave 10% amenity space. In new UDCPR, the Urban Development Department (UDD) has modified the amenity norms and came up with this new proposal in December first week. The proposal expanded the scope of land as far as leaving the amenity space is concerned. It says, ‘There is no need to leave amenity space for the land just less than 20,000 sq meter.
 
The amenity space of 5% of the total area should be left if the land is 20,000 square metres or more.’ Urban Development Department has invited objections and suggestion regarding changes in the proposals of Amenity Space. After following due process (which may take around 6 months), no amenity space will have to be provided for land upto 20,000 sq mtrs. (5 acres). If the proposals regarding amenity space are implemented, it will result in more plotable area per acre.
 
The developer will get more plotable area which may result in reducing his cost of developing the layout. NMRDA has already provided various development reservations for playground, primary school, hospital, fire stations etc for which the land owners can claim compensation in the form of Transferable Development Rights (TDR). If the new proposal for waiving amenity space for land admeasuring less than 20,000 sq.mtrs. (Amenity Space) is implemented, there is possibility of customers, end users and those middle income group people to own plot at a reasonable rate. This is good initiative by the Government for providing cheaper housing for public at large. Lets hope that the Government speeds up the due process of implementing the new rules regarding amenity space in the benefit of public at large.
