The School has moved High Court against a Sessions Court decision that came in favour of the university

After an order from the Sessions court, Pt Ravishankar Shukla University (PRSU), Raipur, has blocked the road passing through the university campus which used to be the thoroughfare for the Radiant Way School. Hundreds of students of the school used to use this road to avoid Amanaka Crossing which consumed much of their time. Now after this development the Radiant Way School has knocked the door of Chhattisgarh High Court against a verdict pronounced by Sessions Court on February 19, 2020.

“The decision of Sessions Court has affected hundreds of students pursuing their study in our school and thus we have moved the High Court,” said The Radiant Way School Principal Bhavna Dubey while talking to ‘The Hitavada’. It takes students almost double the actual time to reach the school by using Amanaka Crossing. Citing the decision of Additional District Magistrate, Raipur, the Registrar of the University has put a notice preventing the school students from using the road passing through the university campus, causing huge inconvenience to students during examination time.

The Principal said that there was a mutual understanding between the university administration and the school some 8-10 years back, following which the university had allowed the students to use its road. The condition was that the school would have to share in the maintenance of the road, said the Principal. However, the university administration later moved a lower court on the ground the road is private property of the university. Therefore, the university cannot allow others to use its property, said the Principal. The school challenged the lower court decision in the Sessions Court. The Sessions Court while hearing the matter delivered its decision in favour of university.

As the university had filed a caveat in the court, the school could not obtain a stay on the issue. Meanwhile, students have submitted an application to the Principal of the School raising concern over the inconvenience they face while coming to school. The students said that they would urge the Governor and Chancellor of the University Anusuiya Uikey to consider their problem. Talking to ‘The Hitavada’, PRSU Registrar Dr Girish Kant Pandey said that the case has been listed in the High Court. “We cannot allow the school to use the road. There has been similar demand from Vipra College and Kanger Valley Academy. A case involving Harshwardhan Tiwari is also pending in the court,” said the Registrar. A gate is being opened from the Ring Road side which would be the main entrance of the university. Besides a stadium is also being constructed in 50 acre land, said the Registrar.
