Justice R K Deshpande and Justice Amit B Borkar at the High Court have directed the Collector, Nagpur, to take into consideration the circumstances pointed out by the petitioner-temple Shri Vitthal Rukhmini Deosthan, Dhapewada, against the restrictions placed on the religious ceremonies in the temple by the the Collector on June 27 last.
With this direction, the High Court has disposed of the writ petition filed by the temple, which was seeking relaxation in the restrictions on the lines of the direction given by the Supreme Court on June 22 last regarding Rath Yatra at Puri in Odisha. The High Court has noted that though the Collector’s order was not challenged, some relaxation has been sought in the restrictions.
The Court has made it clear that the petitioner can approach the Collector in this regard and the Collector can pass appropriate order after taking into consideration the facts and circumstances of the case. The High Court has said that without going into the validity of the Collector’s order, it finds itself unable to interfere in the matter. Advocate N S Warulkar appeared for the petitioner-temple.
