GAD violates rules in promotion for employees of secretariat cadre

General Administration Department (GAD), Government of Chhattisgarh has violated the Chhattisgarh Public Services (Promotion) Rules, 2003 in departmental promotion for officers/employees of secretariat cadre.
 
The highly-placed sources claimed that the GAD violated the Sub Rule (3) of Rule-6 of the Chhattisgarh Public Services (Promotion) Rules-2003 in promotion of secretariat employees in 2020. The GAD promoted only 24 employees from Assistant Grade-II to Assistant Grade-I in place of 40 vacancies in 2020.
Chief Minister Bhupesh Baghel, who also holds the GAD, had given approval for promotion of 40 posts in Assistant Grade-1, but the Departmental Promotion Committee (DPC) promoted only 24 employees from Assistant Grade-II to Assistant Grade-I in 2020.
The sources claimed that the secretariat employees are deprived of time-bound promotion due to this administrative lacuna.
In the month of January this year, some employees of the GAD had written a letter to GAD Secretary D D Singh and Deputy Secretary Jivan Singh Rajput, requesting them for promotion in the secretariat cadre according to the Sub Rule (3) of Rule- 6 of the Chhattisgarh Public Services (Promotion) Rules-2003. The promotion must be carried out for vacancies arising during the course of the year from January 1 to December 31.
This newspaper tried to contact the Additional Chief Secretary and Chairperson of the DPC Renu G Pillay, but got no response and when contacted GAD Secretary D D Singh, he refused to comment on the matter. According to the Sub Rule (3) of Rule- 6 of the Chhattisgarh Public Services (Promotion) Rules-2003, the number of vacancies for promotion during the course of the year, i.e., from January 1 to December 31 will be worked out after taking into account the existing and anticipated vacancies on account of retirement, and promotions to higher cadres/part of the service/higher pay scale of posts. Vacancies arising out of deputation for periods exceeding one year shall also be taken into account. The number of
vacancies to be reserved for public servants belonging to Scheduled Castes and Scheduled Tribes shall be worked out on the basis of the roster which is required to be maintained in accordance with the provisions of Rule 9 of these Rules.
The meeting of the DPC is held every year. The Committee considers the suitability of the public servants for promotion separately with reference to the vacancies of each year starting with the earliest year onwards. The DPC considers the suitability of the public servants for promotion to fill up the unfilled vacancies of the earlier year or years separately and prepare the select list for the relevant year accordingly.
Thereafter, the DPC considers the suitability of the public servants for promotion to fill up the existing and anticipated vacancies of the current year. The DPC assesses the suitability of the public servants for promotion on the basis of their service record and with particular reference to the Annual Confidential Reports (ACRs) for 5 preceding years.
However, in cases where the required qualifying service
is more than 5 years, the Committee sees the record with particular reference to the ACRs for the years equal to the required qualifying service.
