After 26 yrs, MHADA plot-holders have ownership without rights

The people who bought plots from Maharashtra Housing and Area Development Board (MHADA), Nagpur 26 years ago in Wadi area have ownership but without any rights. Even after more than two decades, despite personal reminders and written submissions on numerous occasions by the plot-owners to Minister, Chief Executive Officer, no step has been taken. Some plot-owners even died in the meantime.
The people responding to advertisement published in May 1995 purchased the plots with 9 persons taking plots in the category of Higher Income Group (HIG) and 22 in Lower Income Group (LIG). The plot-owners in good faith accepted and believed that MHADA would not deceive them.
The MHADA (Nagpur) did not make any demarcation of the plots, no board or fencing in and around Wadi-plots, no stretch of development of plots as promised in the advertisement, allotted the plots to applicants. The plot-holders on several occasions sent letters to the authorities concerned, minister, sent reminders requesting them to allot them the right. But in vain.
The plot-holders while talking to ‘The Hitavada’ said, “Unbelievable but shockingly true that even today despite reminders by meeting and in writing, the 31 plot-owners are still without the right to do anything on plot.”
The preliminary job of registering and recording the Wadi Plot Scheme in the Land Records (City Survey) is not completed even today. Actually, it should have been done prior to issuance of advertisement 26 years ago in 1995 for sale of developed plots, felt the owners.
No Board or any fence is erected any time since inception. Nobody could recognise that the land lying is a Wadi-Plot Scheme of Nagpur MHADA. The scheme since 26 years is lying unnoticed like an orphan without any identity. Unfortunately some people have encroached the land and it has become difficult for everyone to identify their plots.
No measurement and demarcation of plots is done by MHADA despite numerous appeals in this regard. No Registry of plots is done despite numerous appeals by plot owners.
No Development Plan (DP) of the Wadi-Plot Scheme is available in the office of the MHADA. Hence, the same could be seen only in Wadi Nagar Parishad.
No development of Wadi-Plot Scheme is done as was promised in the May 1995 advertisement for sale of plots. There is also no identity of scheme as well as the marked plots of plot owners therein.
Despite the plot owners can not do any construction work, they are paying ground rent honestly every year.
Plot owners are contemplating to either agitate or adopt legal methods for awakening the authorities from the deep slumber. Meanwhile MHADA has accepted, the encroachment has taken place on the land but said that as per rules, those who bought the plots should have done some construction work on it.
