The State Government has assured the High Court division bench here, consisting of Justice Anuja Prabhudessai and Justice Vrushali Joshi, that the directions given by the HC on September 21, 2023, through its order, will be complied within two weeks. The HC has recorded this assurance intimated to it by the Additional Government Pleader (Addl GP), Dipak Thakare, in the Suo Motu PIL registered in the name of C H Sharma and others, on behalf of the State Govt to the effect that the amount of Rs 5.67 crore sanctioned from out of DPDC funds for setting up Digital Cardiac Cath Lab at GMCH and Super Speciality Hospital here, will be transferred from the RBI to the account of GMCH, Nagpur. Another direction has been to the Collector, Nagpur, for initiating tender process in accordance with rules for procurement of various machines listed in the List 'L-1' for which funds have been provided entirely or substantially by DPDC.
 
The HC has also accepted the statement made by the Addl GP that the process for issuance of tender for purchasing Robotic Surgery System (RSS) will be initiated within 2-3 days. Advocate S M Puranik appearing for the respondent -Nagpur Municipal Corporation (NMC) informed the HC that its direction of November 10 last for holding meeting on November 20 last and taking action to remove encroachment infront of the main gate of the GMCH, obstructing the entry of ambulance, before November 30 last, has been complied with and the encroachments have been removed. He has submitted further that the Assistant Commissioner, Dhantoli Zone, of the Nagpur Municipal Corporation (NMC) shall ensure that there shall be no further encroachment on the said land. The HC has directed its Registry to list the PIL after two weeks. Advocate Anoop Gilda is amicus curiae in the case. Advocate Firdos Mirza represented the State Govt. as Special counsel. Advocate Mugdha Chandurkar held the brief for the Union of India.
