RoC issues show cause notices to Mehadia, NVCC office-bearers

Taking cognisance of Bombay High Court order dated February 22, 2022, the Ministry of Corporate Affairs had issued direction to Registrar of Companies (RoC) Mumbai to conduct inspection of Nag Vidarbha Chamber of Commerce (NVCC) under Section 206 of the Companies Act, 2013. After inspection of books of accounts, and other records under Section 206, read with Section 207 of the Companies Act, and giving opportunity of personal hearing to Ashwin Mehadia and his associates, the RoC has, on Friday, issued Preliminary Finding Letter (PFL) to present and past office-bearers and auditors of NVCC, directing them to submit their response within seven days from receipt of the PFL. Ashwin Mehadia has been asked to explain, why he should not be punished under Section 447 of the Companies Act for the offence of fraud for making wrong presentation of facts before members in extra general meeting regarding then pending Standard Rent Case and surrendering the tenancy rights of NVCC.
