National Medical Commission to monitor ‘adjustment’ transfers during inspection

No medico to be transferred twice in an academic year 
 
To curb irregularities during inspection in Government Medical Colleges, National Medical Commission (NMC) has asked the Departments of Medical Education of all the States and Union Territories (UT) not to change posting of teachers in one academic year. In 2010, the then Medical Council of India had notified that no faculty would be accepted as faculty of other medical college within 2 years. In a letter sent to all the Departments of Medical Education of the States and UT, NMC has pointed out, “It has been brought to the attention of Medical Assessment and Ratings Board, NMC that transfers of faculties are being made in Government Medical College in the State Medical Colleges for the purpose of fulfilling teaching/faculty requirement before the inspection by the Board.”
 
This practice of ‘compromise’ or ‘adjustment’ transfers is not new to medical colleges while the inspection is on, because they don’t have staff as per the rule of apex body. The Board has also noticed that various Writ Petitions are being filed in various High Courts by faculties who have been transferred by the State Government from one medical college to another alleging that their transfer will result in deficiency in the first medical college. The Commission has put onus on medical colleges and State Medical Education Departments regarding following the rule.
 
According to Commission, it is the responsibility of the medical colleges to ensure the faculty requirements as laid down in the Minimum Standard Requirements Regulations for the sanctioned capacity of Under Graduate as well as Post Graduate courses. Secondly, once a faculty for one academic year has been counted in a medical college, the same faculty cannot be accepted as a faculty of another medical college in the same academic year. A faculty is required to make a declaration to this effect in the declaration form to the commission. NMC has further pointed out, “The issue of transfer from one Government Medical College to another concerned it is within the administrative domain of respective State Government. It is upon the State Government to ensure fulfillment of faculty requirement and transfer from one Government Medical College to another if made for the purpose of rectifying deficiency in one medical college should not cause deficiency in another medical college.”
