The Youth Congress State President, Kunal Raut, who was arrested for vandalising government property and defacing a poster featuring Prime Minister Narendra Modi during a protest at the Zilla Parishad office premises, was brought before the court on Monday afternoon. The court remanded Kunal to police custody for a period of two days. Upon learning of Kunal’s court appearance, a large number of supporters gathered in the Nyay Mandir premises. In the afternoon, Kunal was escorted into the court premises through the entrance of the new building. The police, seeking a five-day custody, aimed to interrogate other accused persons and conduct a thorough investigation into the case. Defense lawyer opposed the police custody and argued that the charges registered only carry a maximum punishment of five years.

 

He cited Arnesh Kumar case and contended that the arrest was procedurally flawed. He informed the court that the police had issued a notice under Section 41A of CrPC to Kunal via WhatsApp at 1 am, violating established protocols. Hence, he argued against Kunal’s detention in police custody. After considering arguments from both sides, the court granted a two-day police custody for Kunal. The defense plans to file an appeal in the High Court on Tuesday. It should be noted that last Saturday, Kunal and his supporters defaced a banner featuring PM Modi at the Zilla Parishad office. Following this incident, a case was filed against Kunal and his supporters at the Sadar police station. On Sunday, Kunal was arrested in Kuhi by the police. The police anticipated potential attempts by BJP workers to retaliate by defacing Kunal’s face. As a result, stringent security measures were implemented in the court premises.
