Collector issues orders under Defacement of Property Act 1994

As per the notification released by the Election Commission of India, casting of votes will be held in the district on May 7 and counting of votes is scheduled on June 4, 2024. After this announcement, Model Code of Conduct (MCC) has been imposed in the district. As per directions of the Election Commission and Section 3 of Madhya Pradesh Penalty for defacement of property Act 1994, whoever defaces any property in public view by writing or marking with ink, chalk, paint or any other material, without a written permission of the owner of the property shall be punishable with fine which may extend to one Rs 1,000.
 
Collector and District Magistrate of the district, Kaushlendra Vikram Singh issued orders that candidates who are contesting elections, can install flags, posters, banners and do wall writing only with written permission of the owner. For the same, a No Objection Certificate (NOC) will be issued by the Municipal Corporation within three days which is to be obtained by the candidate mandatorily after submitting the receipt of the expenses of the same along with the other necessary documents to the Returning Officer.
 
The Collector also asked the candidates to make sure that no such banner, poster or flex board should be displayed which would create a sense of disharmony and nuisance among any community. The order also says that during the
election process, if any incident of defacement of any public or private property is committed by any candidate or advertisement companies, then the landlord will be eligible for submitting a First Information Report (FIR) to the police. For the areas coming under the boundaries of the district, a special committee will be constituted which will work upon developing the defecated properties into their original form. These will come into immediate effect and any violation of the law will be punishable under the Act.
