The Nagpur Bench of the Bombay High Court, consisting of Justice Anil Kilor and Justice Rajnish Vyas, strongly criticised the authorities while hearing a Public Interest Litigation (PIL) about the environmental and health crisis at the Bhandewadi dumping site in the city. The PIL was filed by vigilant citizen Anil Wadpalliwar, who raised concerns about the serious health risks and civic problems caused by the dumping ground. The Court issued notices to all the respondents and directed the Nagpur Municipal Corporation (NMC) to seriously consider shifting the dumping yard outside city limits.

The judges pointed out that just as the Central Jail, which was earlier located in the heart of Nagpur, had to be moved to the outskirts as city expanded, the Bhandewadi dumping yard must also be relocated. They noted that the site is now surrounded by thickly populated areas, colleges and hospitals making its current location unsuitable. The petitioner has demanded an end to unscientific dumping and open burning, proper segregation and management of waste, creation of buffer zones and strict enforcement of environmental rules.

The Court also directed the Maharashtra Pollution Control Board (MPCB) and the Ministry of Environment, Forest and Climate Change to ensure compliance with all regulations, regularly monitor the site and take steps to reduce pollution. The aim is to achieve scientific waste management, protect the health of citizens and promote sustainable solutions. During the hearing, the petitioner’s counsel also stressed the risks faced by the growing population in the area, as well as the impact on educational and medical institutions nearby. The matter will now be heard again after six weeks, when the respondents are expected to file their replies. Advocates S P Bhandarkar appeared for the petitioner, while Advocate Puranik represented the NMC.
