“SECTION 128A of GST provides relief to taxpayers while ensuring compliance,” said CA Chinmay Joshi, Partner at Jodh Joshi & Co. He was speaking on the topic ‘GST Amnesty: Your Gateway to a Fresh Start’ at the weekly session of Vidarbha Management Association (VMA), held at Chitnavis Centre, Civil Lines. CA Chinmay Joshi further said that, Section 128A was introduced in the Central Goods and Services Tax (CGST) Act, 2017 through the Finance Act, 2024, and came into effect on November 1, 2024. It provides relief by waiving interest, penalties, or both for tax demands raised under Section 73 for the financial years 2017-18, 2018-19, and 2019-20.

“The scheme is designed to ease the burden on taxpayers, particularly businesses facing past tax dues, while ensuring compliance with GST laws,” he added. Elaborating the GST Amnesty Scheme, he told the gathering that it applies to tax demands raised under Section 73, which pertains to non-fraudulent cases where taxes were not paid, short-paid, or erroneously refunded. The session was moderated by CA Pravin Kumar Limaja, while Niket Agrawal was the session in-charge.
