- HC directs NMC to submit report on Tuesday
The Nagpur Municipal Corporation (NMC) informed the Nagpur bench of the Bombay High Court on Friday that action will be taken against the illegal birds market at Lakadganj on February 1, under police protection. The market has been accused of illegal capture and sale of wild birds and various animals kept in cages.
The information was given during the hearing of a public interest litigation (PIL) filed over the illegal activities at the market. The PIL will now be heard on Tuesday.
A division bench comprising Justices Anil Kilore and Raj Wakode orally questioned the authorities on why the market had not been removed even after two months of the illegality coming to light.
In response, the NMC assured the court that strict action would be taken on February 1.
The High Court has directed the NMC to submit a detailed report on the action taken by the next hearing.
In an earlier hearing, the High Court had issued notices to several authorities, including the Deputy Conservator of Forests, Chief Wildlife Warden, Principal Chief Conservator of Forests, Police Commissioner, Municipal Commissioner, and the Maharashtra State Wildlife Board.
exotic species, and other animals allegedly kept in small cages without proper food or water and openly sold by traders.
The petition states that some traders even promoted their illegal activities through YouTube videos uploaded on November 23, 2025. The petitioner submitted photographs and videos as evidence to the court.
The petition further claims that despite written complaints and repeated reminders submitted on September 24, no action was taken by Lakadganj Police or Forest Department. As a result, the petitioner approached the High Court by filing a PIL.
The petition points out that trading in protected species is a cognizable and non-bailable offence under the Wildlife (Protection) Act, 1972. It also refers to violations of the Prevention of Cruelty to Animals Act, 1960, and the Pet Shop Rules, 2018, which lay down rules for registration, animal care, hygiene, and proper premises.
The petitioner has also alleged violation of Articles 21, 48A,
and 51A(g) of the Constitution, stating that the authorities
failed to protect wildlife and prevent cruelty.
