A single bench of the MPHC comprising Justice Himanshu Joshi expressed strong displeasure over the petitioner bringing an aborted foetus into the courtroom.
It remarked that the petitioner’s bringing an aborted foetus into the courtroom was completely inappropriate and illegal. Indeed, a foetus, a human body, must be handled and disposed of in accordance with the Biomedical Waste Management Rules, 2016. The removal and display of such remains without permission in a dignified public space like a courtroom not only violates due process but, prima facie, amounts to desecration of a human corpse, punishable under the Indian Penal Code, 2023. Such behaviour could also undermine the dignity and respect of the court.
With this harsh remark, the High Court warned the petitioner not to repeat such an act in the future before this court or any other judicial forum or public authority. This act attempts to undermine the dignity, decorum, and functioning of judicial proceedings, which is absolutely intolerable.
About the matter it may be mentioned that Dayashankar Pandey, a resident of Rewa, arrived with a foetus on March 9.
Dayashankar alleged that he
worked at Maruti showroom in Mahanadda. During that time, he exposed a Rs 200 crore scam, which is why he has been facing repeated attacks. Dayashankar, representing himself, argued that the Rs 200 crore should be recovered from the showroom and he should be given compensation of Rs 82 lakh. Deputy Advocate General Vivek Sharma, representing the State Government, and senior advocate Manoj Sharma, representing the Maruti company, argued that the petition was based entirely on fabricated allegations. The petitioner did not submit any written complaint filed with police officials.
